I recently purchased a home and decided to get 2 roommates to offset the mortgage cost. I will call them Jane and John. It turns out Jane and John do not get along too well with each other, although they both get along fine with me. They have had a few fights when I wasn't around. Jane also let John borrow her ebay account to buy some items and he proceeded to run up $1000 worth of stuff that he was late paying off although he worked it out w/ the sellers and did not get any bad feedback for this. Jane no longer feels comfortable with him living in the house and has threatened to leave if I don't kick him out. I agree with her that he can be moody and might indeed have $$ problems. He got laid off about a month ago and paid last month's rent by selling off some of the large amount of cr*p that he owns. So - if someone has to go, I would rather it be John. I approached him last night about leaving and he said he would be nicer to Jane, etc - basically he does not want to leave. Jane says if he is not out by the end of the month (9 days) she is leaving. There is no lease - everything is verbal and month to month. I asked them for 30 days notice before leaving but never mentioned how much notice I had to give them.
My question: Can I legally tell him to get out in 9 days? If he says no, can I throw his stuff in the driveway and change the locks? If he resists this, can I call the police? I would hate for it to come to this but I fear it may - it turns out I think that he has had problems living w/ others before...
