What judges can do depends upon state law, and laws are different in each state. What they will do? Probably something less than what the can do. Consult a local criminal defense lawyer, preferably one familiar with your sentencing judge, about your chances.
My lawyer I had when I was sentence has since past away. After sentencing the judge asked why wasn't an expungement negotiated. He told me to file a motion for expungement according to state law, only the prosecutor can recommend an expungement, but even though I didn't do jail time my suspended sentence didn't allow for expungement. I was told by a lawyer that the only way it could be done is if my sentence was modified to a lesser sentence. That's why I wanted to know if a sentence can be modified after probation has already been served before I spend money on a lawyer to file a motion.
