    Default Disobeying a Traffic Control Signal and Improper Lane Usage

    I'm from Illinois.

    I received my first ticket on October 22 for not coming to a complete stop. I'll give them that one, I definitely did not stop. However, I'm wondering how this will conflict with the ticket I just got today which I don't believe I'm guilty of.

    I got pulled over at about 2AM because my driving was erratic and the officer claims that I went over the line many times. I don't recall doing this at all but I can't be 100% sure of this. Anyway, I was given a field sobriety test followed by a Breathalyzer test which I both passed with flying colors. I was wondering what the chances are that I would win a not guilty plea even if I did have slightly poor driving. I can't imagine it was that bad. I'd also like to know if it would be better to ask for a trial by judge or a trial by jury. I established to the officer many times that I was tired, as well. I don't know if that's a good thing or not.

    Aside from that, if I would have poor chances of winning that case, would I be able to write in the "Avoid a Conviction on Your Driving Record, Plead Guilty, Register for the Driver Safety Program" on both tickets to avoid any increase in my insurance?

    I doubt that you will be able to avoid an insurance consequence if you attempt that with two tickets. Ask the Illinois DMV or your insurance agent. Or, if you consult a lawyer, ask the lawyer.

    I personally would consult a lawyer about the possibility of contesting both tickets - if you can beat one and use the driver safety program on the other, you end up where you want to be.

    Telling the officer, over and over, that you were tired was not a good thing to do. In essence, you were explaining why your driving was erratic....and being tired is not a valid defense.

    I only said it once that I was tired. I more tried to point out that it was not my car. The tired thing was just me trying to not have to take a field sobriety test at 2:30AM in the 20 degree weather without a jacket.

    Since you wrote "many times", I assumed that probably meant you told him more than once. Also, are you sure it was 20 degrees?
