    Unhappy Baby Put Store Items Into My Purse

    Im 22, and im living in the state of California. ..my husband is in the military and im a civlian, I have a crazy shoplifting story and i dont know who to turn to. I was on base when this incident occured and i had my 3 yr old daughter with me. I was looking at all kinds of things through out the store and I gave my daughter a wallet to play with because she was whining for it, so i gave in and let her play with it...keep in mind the wallet had a HUGE security sensor on it which is impossible to get through security with ...anyways, i had also gotten some winter beenies ( hats) in the cart as well, my daughter was playing and she brought her blankie into the store with us and through out the store, somehow the beenies ended up underneath her( as i later found out when i got stopped) ( she was laying down in the cart) anyways, i walked out of the store, and the alarm sounded , i stopped and turned around and looked down into my cart, only to look down into my purse and see that my baby was playing and unknowingly put the wallet in my purse. My husband is a higher rank in the military, and we have money, i dont need to steal a couple hundred dollars worth of things when i obvioulsy have the money. They pulled me in the back, with my child, and were screaming at me, juding me and questioning me and telling me that my story is ridiculous b/c they had ME, physically on camera putting all of those things in my purse. NOW- i know for a fact that i DID NOT put any thing in my purse with my own hand, they asked me " then WHO DID??" and i hated to even say my 3 yr old, but its the truth. Im a bad mom for not watching her EVERY MOVE, but they made me feel like i was just using her to get off easy. Im willing to take full responsibility for this, i understand that i couldve prevented this, but when i left the store and saw that nothing was in my cart, i assumed that my daughter had throw things out like she usually does. Anyways, the police were called and now im going to have a court date and Im so embarassed to even be involved in anything like this, but what do i do??? Im making myself physically sick here worrying about whats to come. What can i expect?? when i was 16 i got caught shoplifting in a department store but the police were NOT called or involved at all , but im so afraid my teenage mistake will affect this mistake and somehow get me put in jail?? I need some advice quickly before I drive myself crazy!

    If Police were not called back when there is no record. I doubt your record (if you had one) would be applied to an adult offense. Consult with a criminal defense Attorney and discuss your options. It seems to me you would qualify for diversion if your court has such a program

    Get a lawyer, get the videos, and hope that they back up your story.

    This isn't going to be the first time the authorities have heard the "My baby did it" excuse. Usually it's a fiction.

    Mr. K is correct hire an Attorney and get video through discovery process if it backs your version DA may drop charges.

    Excellent point and this fact will work against you as "you" selected the merchandise! You really need to talk to a Lawyer

    I would strongly urge you to not make such a claim to the courts. In my area, we had a judge caught stealing steaks at a grocery store. He did not need to steal yet he did. There are many many cases in which there was no need to steal yet things were stolen. Think about Ken Lay or Dennis Kozlowski. Did they need to steal? I am sure they had more money than you do yet they still stole millions of dollars.

    Not a good arguement to try to make.

    i was in the store for a very long time, i gave her that wallet when we first walked in, about about an hour, i totally forgot about it. I guess when you have a crying child, the last thing on your mind is if your kids are putting things in your purse. I guess in this case i shouldve paid more attention . When we walked out of the store, and the alarm sounded, i looked down and and didnt see anything in my basket, until i realized that it was possible that i made it out of the store with something i hadnt paid for. Im an honest person and had i seen something, i wouldve turned around and handed it back to the lady at the checkout desk.

    As a parent of five children I never give in to my children whinning it developes poor habits on thiers and mines part. Sadly it was your fault this occurrd intentional or not. You did walk out with items of unpaid for merchandise. We seem to be focussin gon wallet but what of the beenies mentioned? Here are even more items. This makes it look intentional even more. What you need to do is hire a criminal defense Attorney and discuss your options

    THis story is just like the others. YOU LEFT THE STORE WITH TWO, THAT IS TWO items of merchandise you selected and did not pay for. The hats under your daughter and the wallet. YOu are guility of retail theft by the law. The only and I mean ONLY chance you have is to get the video and see if it really is how you say it is. Plus you have left so much out of this story. Like how did you daughter place it in your purse if she was on her back in the bottom of the cart? did you buy other merchandise? etc.
