    Default Possession of Marijuana

    Last night my friend and I were leaving my subdivision on the way to the bar a mile away when two police cars aggresively entered. I proceeded to a complete stop then exited. It wasnt a quater of a mile later that I see the police car exiting the subdivision in persuit of my vechile. After I turn at a stop sign he flicks his lights on and pulls me over. He tells me that he had pulled me over for having illigal tints, which is true. Then proceeds to ask if we had been smoking marijuana and tells me that he sees some marijuana on my sweatpants. We had been smoking earlier but there was nothing on my sweatpants, however, he tells me to get out of the car and that I was arrested for possession of marijuana. As I am in the back of the police car my friend get questioned and taken out of the car searched, cuffed, and put in the back as they proceed to search my car. They find a small bag of marijuana that was mine and my friends grinder, which breaks the marijuana. While sitting in the back I see on the police computer that someone in my subdivision called regarding two white males tried to break into their car and its on camera. Which then makes sense why they were so fast to enter my subdivision. I took the blame both the marijuana and grinder. They let my friend go with my car to go to bank and told him that I would be ready for release in an hour and bring 100$ bail. I asked the police officer about the vechile break in and he told me that he knew it wasn't my friend and I because my friend was arab and we didnt fit the discription. I know wrong place wrong time.
    He wrote me for possession of marijuana. I would like to know if it was fair for him to arrest me for ''allegedly'' seeing marijuana on my sweatpants? which then, allowed him to search my vechile. Since I have to go in front of the judge soon, what are my options in court so this doesn't go on my record? This is my first offense.

    Your lawyer can attempt to convince the court that your clothes were clean, and can bring a motion to suppress alleging that the search was improper. Unfortunately I don't expect the "He couldn't have seen marijuana on my clothes" argument to work, because in fact you did have marijuana and a grinder.

    Laws are different in each state, and you didn't follow the instruction to identify where this occurred, so consult a local criminal defense lawyer about the availability of dispositions which might allow you to avoid a conviction.
