Hi, I am hoping someone could give me some info here. My elderly mom was being overcharged and double billed by a crooked contractor. Instead of trying to settle with her at a fair amount, he went ahead and filed a builder's lien on her property with BC Land Titles. The thing is the lien was filed almost a year after he had stopped work on the property, leaving behind a bunch of incomplete projects. Land Titles refused to take the lien off even though he had blatantly violated the deadline of filing on or before 45 days after work was stopped (we have proof of this). Some people I have asked said that if nothing happens within a year, the lien is null and void. But others have said that it will stay on her title forever until she sells, in which case, she'll need to pay a lawyer to go to Supreme Court to get the lien released.
Any help and advice on this would be much appreciated!
