    Question Will Chapter 13 Provide Relief From Creditors

    Hello,
    I need help and I reside in Cincinnati, Ohio for 4 years but previously lived in
    Baltimore, Maryland for 16 years where I filed Chapter 7 and discharged in
    2001. During my stay in Cincinnati which is home, I ran into some terrible
    time with finances because of employment and frequent hospital visits due
    to health issues. Nevetheless, I have been summon by court on two of
    the credit cards I assume while I have been here . I went to court on one
    and they wanted to know my asset which are none and my employment
    is a Teacher Assistant with the Cincinnati Public school for 6.0 a day which
    is not stable due to cutback each year. My question now is that my second
    summon to court for credit card seem serious well both do and I want to make right with my creditors but I don't think I have enough money for Chapter 13. I know chapter 7 is out but if I put chapter 13 into motion will
    the filing fee put all my creditors in a hold status from garnishment. I have
    a car loan that will be payoff in July 2008 . I am tired of calls which I thought my life was over with debt in 2001, but domestic violence had me to flee to home for safety therefore, I found myself being comfort by plastic and now I'm back to square one. I did my chapter 7 by myself without lawyer did not have the fee and I won't have it now. Please advise about the route I need to take. By the way, I heard taxes owe can be included in chapter 13 I already have a $45.00 IRS payment plan. I need one plan that will be the umbrella for all except car note and my total debt
    is about $10,000.00. I want to be good steward in my finances !

    Once the automatic stay goes into effect, unless and until it is lifted, all creditors are to stop trying to collect the debts you owe. (You, of course, need to list your creditors with the bankruptcy court such that they are notified of the pending action.)

    I would like to thank you for your response! On Nov.12, I have appointment with Consumer credit counseling but I really want to file chapter 13 and there is a $79.00 charged for this class as a pre-filing class. I was told if I told the Bankruptcy court that I am representing me
    that the "mean test " could be waive. Do you know about this? I need so much info ! I have pulled all three credit bureau report ! I got homework to do ! Is there anyone want to help me "Pro Bono" in Cincinnati, Ohio. I did my chapter 7 in Balitmore but this might be quite the headache but I have no choice but to press on. If anyone feel compassion for me here is my

    You were apparently told that if you cannot afford the credit counseling fee you can check with the bankruptcy court to see if you qualify for a waiver of the fee. To get more information, you contact the bankruptcy court.

    If you believe you qualify for legal aid, try to get help through legal aid. I doubt that a private lawyer will offer you free representation.

    Hello anyone,

    Can anyone tell me about the pre-filing certificate from Consumer credit counseling that cost $75.00 and the post $75.00. The Bankruptcy court told
    that they don't have a voice in this matter. However, I do need this before
    I filed another fee to pay this is why you are filling:. If any paralegal or attorney read this and advise can I truly do this by myself I done chapter 7, but this might be confusing but I am in for the betterment of me.
    By the way, Where can you attain the packet for chapter 13 or can you download from the internet! Any help is appreciated!

    You should be able to download forms from the website for your bankruptcy court. They are on every bankruptcy court website.
