I am a resident of TN and I am being sued by my previous employer for "hacking" into the emails of the owner, Corporate Counsel, and CFO. The papers state the following:
1. Judgment against the defendant in the amount as determined by the court based upon the losses sustained by the plantiff due to the illegal access to emails.
2. Cost incurred in investigating the illegal access to corporate email accounts
3. Punitive damages in the amount of $100,000 and for General Relief.
I received the passwords through one of their IT people and he is being named in the suit as well. I do not have that kind of money so my questions are:
1. Is this something that could be discharged under Chapter 7.
2. I believe that my husbands income along with mine are above the states median level for Chapter 7. So if we got a divorce would they still count his income? Without his I don't make enough to pay for food and rent much less 25% of this.
3. The only asset we have is our house. Could they force us to sell it and they get the profit. With the housing market now it would take it years to sale.
Any answers would be beneficial.
