    Angry Married but Not the Father in Tennessee

    My boyfriend has been legally separated from his wife for almost 6 years. She just had a baby by another man and put my boyfriends name on the birth certificate my boyfriend never signed anything acknowledging paternity. my question is since they were married at the time of the birth can she take my boyfriend to court and make him pay support for a child that isn't his ?

    He needs to petition court to establish paternity. As husband (during conception) he is "presumed" Father

    Be careful here. A paternity suit typically must be brought by somebody who is claiming to be the father, or by the mother. If somebody claims to be the father and the mother doesn't answer the suit, he could "win" by default and get a court order declaring him to be the father. Under these circumstances I would normally suggest that he file for divorce and allege his nonpaternity of this child right in his complaint.
