    Default Threat of Being Sued by Asset Acceptance LLC

    I received a letter from Asset Acceptance LLC today.
    The letter states as follows:

    Dear ,
    The above referenced account has been referred to this department [Legal Department] In the past, Asset Acceptance LLC has attempted to contact you to resolve this account. It is in the best interest of the parties to settle these matters. Please contact the undersigned at the number provided to make arrangements to repay this account.

    If this department does not hear from you, we will assume that you do not which to resolve this matter and we will refer it to an attorney in your area for legal consideration.

    I reside in Illinois, my last payment was in 2004 after some not so successful payment arrangements with Dell computers. (They were to take out money out of my bank account each week, but still called to collect and had no record of my payment arrangement so I stopped paying) My current debt with interest and fees still recurring is 3098.49. Should I be worried about being sued or is this just an empty threat to get the money? I've been threatened about legal action from Famous Barr before it was Macy's and the letter I received was from an attorney threatening legal action, but none was ever taken. What do you guys think?

    I have not disputed the debt, contacted or talked to the debt collectors regarding this account.
    Thank you for any advice.

    I had to reply because I found this to be an odd coincidence. I received a phone call last night from an Asset Acceptance. They called about 2 old debts I had, the accounts were closed in 1999, they wanted to collect on these debts. I have literally not heard from anyone about this since 1999. I believe I had a settlement on the accounts in question, but need to dig up my paperwork. I just found it odd that this company is contacting you also about a very old debt.

    There are agencies that "buy" debts. Its thier business. You might want to check to see if ther eis a statute of limitations on collecting debts (I don't know)

    Send them a debt validation letter and make them prove their claim and prove that it is not out of the SOL.

    Which, even if there were any reason to believe that the Illinois statute of limitations had run, is not their obligation in response to a validation letter.
