    Default Discrimination Case Over Denial of Service in Illinois

    Hello I was looking for some input on this event. This past weekend I went to a local late night restaraunt with my girlfriend. When we drove into the parking lot ( I was the driver ) we seen a lady who was a employeee of this business and she seen us. I pulled up to the order window and waited for someone to take our order. However there was no responce from the order box. I waited a few moments then pulled up to the window itself . Thats when they started turning the lights on and off I looked at the hours of operation and we were well within the listed hours. I waited and then seen someone looking out at us so I walked up to the walktru window and knocked then I saw some workers staring at me and one came up to the window yelling and making rude comments .I will say this isn't something I've ever come across before she wouldn't give me a reaon why she wouldn't serve me none of the other workers came to help or say anything I asked for a manger and then she just walked away. This is a major chain the workers were all of a different race than my self my girlfriend and I are of a different race. I contacted the manager the next morning and told of the event and was brushed of. I told the area manager and was brushed off I told the corporate office and was told I would receive a call back nothing has happened yet. Any thoughts about suing the company over discrimination ?

    Can you prove that the ONLY reason they didn't serve you was because of your race & what damages did you suffer?

    Once racial discrimination is established, the question of what actual (out-of-pocket) damages result from a denial of proper service by a restaurant isn't particularly important. The damages awards can be quite substantial.

    Jayd, an eatery is a public accomodation, and thus they can not refuse service to someone based on protected classes. HOWEVER, and this is a big one, proving such is very very hard. Convincing a trier of fact this is the sole reason is not a water slide ride.



    If you sincerely belive this was the case, make the "Corporate office" aware of such treatment and ask for an internal investigation.

    Thanks for the replies. Well I haven't received any legal help or call backs from local lawyers so i'm going to file a small claims in court asap. Does this sound like the only way since I haen't even recieed a simple call or apology from there office or management ? I'm ot putting this off any longer and once I do i'm sending it to there corporate office. Thanks

    Unless you tell us something that suggests that racial discrimination actually occurred, or that you otherwise suffered damages, I personally wouldn't expend the filing fee.
