    Default Harassment After Accepting ACD

I have a neighbor that has nothing better to do with their life than to make mine misserable. I've had the police at my house at least 20+ times and have never gotten a ticket or anything except the time where i argued with the police officer since it was the 4 officer (6th visit) that was at my house within two days on an issue of an open fire. I was accused of burning my neighbors leg with my motorcycle while she was on a mountain bike and i was moving 10mph with my wife on the back???? ( physically impossible ). So after going to court 4 times and wasting $500 dollars i settled on an ACD. Now here i am again being accused of absolutly nothing. The police report states i called her a name a few times and now i'm back in court and i allready have given my lawyer $750 which will only be half of what i will owe if i decide to have my lawyer prosecute. All steming from an incident of me trimming pricker bushes that were hanging into my yard which is completey legal. The neighbors boyfriend came onto my proprty and got into my face telling me i can't do that?? My lawyer told me that i cannot sue her for his costs? I have done nothing wrong and it's just my neighbor being an @#$. These are all just lies. Cant she be held accountable for filing false accusations?

You are stating that you were criminally charged, and rather than fighting the charge took an adjournment in contemplation of dismissal. Is this new incident coming before that charge has in fact been dismissed?

As you didn't follow the instructions to identify the state where this occurred, we can't do much more than say "talk to your laywer."

I'm sorry, NY. This will be the second time she has filed a harrasment suit against me when it is she who is harrasing me. This new case is coming right after the 6 month acd was up. My lawyer even told me she would try to pull this stunt again to keep trying to get me in trouble. I wish i would have fought the first time cause it was completely made up story by her. I just didn't have the cash to keep going. Now i'm paying for it either way cause here we are again wasting my time and money from her lies. Plus on both instances i never even spoke to the police about what she had called them for.

This lady calls the cops on me when i rake my yard. I'm raking the leaves from her trees from the back of my yard to the front of my yard ( keeping the leaves in my yard the whole time ) and she calls the cops????? How do the police even take this seriously???? The lady stands there and stares at me when i'm doing this. Just waiting to instagate me, then she tells the police that she feels threatened by me???

Unfortunately, your accepting the ACD lent credence to her allegations.

Well i plan to go all the way this time which is costing me $1500. So your saying we can not bring that incident up and easily prove what a bunch of b.s it was?

You need to consider installing cameras to cover yourself. We've got a similar situation with neighbors that call the police and make claims of harassment or animal abuse. Fortunately, they're doing this to us and to another family, and we now have video cameras watching ourselves to protect us. (Nutty, huh?)

That way we've been able to absolutely prove the complaints false in almost all cases by just showing the video of the alleged incident to the police. Notably absent is any of the alleged harassment, and especially funny was the absence of the person who allegedly carried out the harassment. Wasn't even outside!

I'm sorry for the anguish that you are going through. I go through it every time we get another false report and I get to spend hours searching through video, burning the applicable camera views or camcorder footage to a disk to give to the police, and preparing a written statement. But it's better than the alternative, letting them lie about anything, which gets more expensive than a few hours of frustration and the price of a few cameras and DVDs.

It sounds like you're actually being stalked. The last thing that you want to do as a stalkee is to become angry and actually say anything. The incident will be reported to the police and exaggerated beyond your imagination.

Also, the neighbor's behaviors towards you will probably never stop. Our situation has been going on almost two years. I try to avoid mowing or working on the yard when it looks like a set-up is in progress. If something absolutely needs to be done, one of us stands there with a video camera and films the entire thing. It's not the way of life I would have chosen, but it's my reality.

Once she accused me of throwing leaves onto her lawn. But i'm the one with a video of her throwing leaves into my yard! She couldn't even say they were mine when there are no trees in my yard!!! This is a 60 something year old lady that just moved here from venezuala about 3 years ago. It's like she thinks breathing is illegal here in the U.S.

So is it possible to counter her and make her pay for my lawyer on a he-said / she-said case?
