Default Husband Waiting for Deportation in Jail

    hi i'm from oklahoma.

I know your gonna tell me to get advise from an immigration lawyer but i just wanted to see what others opinions or advices would be. i'm a permanent residence and i married a guy who came here legally but overstayed. he applied for asylum and all those tenth circuit whatever that is...anyways..i'm pretty sure he's been an overstay for more than 3 years...for sure..but his passport is not expired or anything..he works legally..well gets checks and pays taxes and all those normal stuff...and he doesn't have any criminal records..we were gonna wait till i get my citizenship which, i get in two years..to file for his status. But the immigration people came and got him already and now he's in jail waiting to be deported. i don't know how long its gonna take him to be deported to his country, indonesia...i know being married isn't gonna help anything anymore so my questions are:

    1) can i buy his plane ticket so he can get out of jail sooner, so he doesn't have to wait for other people?
    2) can he apply for canadian visa after reaching indonesia right away(atleast a week) or does he have like a bar or does he have to wait a certain period of time to apply for canadian visa?
    3) will his country let him come back?? cos i heard somewhere sometimes the country doesn't want them back and so they have to stay in jail.

    thank you in advance...

Default Re: Husband Waiting for Deportation in Jail

If he's eligible for voluntary departure, his departure can help him avoid or shorten his period of ineligibility to reenter the United States.

Canada doesn't impose restrictions on immigration based upon the overstay of a U.S. visa. Canada has its own immigration laws.

Once any period of ineligibility expires (or before then if he qualifies for and obtains a waiver) he can seek permission to reenter the United States.
