    Default Ex is Trying to File Child Support but No Father is Listed on Birth Certificate

    About 3 1/2 years ago, my boyfriend was in relationship with a girl who got pregnant but wasn't sure who the father was. The girl had told him that he was the father (because she really wanted to be in a relationship with him and wanted him to be the father), but he knows that he isn't the father. She never had a name listed on the birth certificate when the baby was born, or after the birth, for who the father is. The baby is now 3 years old. A friend of the girl had called my boyfriend the other day and told him that this girl was taking him to court for child support. I was just wondering if she can do that even though he is not listed on the birth certificate? And how long does someone have to file for child support after the birth of a child? Also, does anyone know where I can find out if my boyfriend does have a court date for this?

    If he was in a relationship, how can he be so sure the child isn't his? Is your bf sterile?

    The ex can not list anyone as the father unless he was at the hospital when the child was born and signed the AOP.

    When the bf is served with the court papers he can request a paternity test to verify if the child is his. If he is proven to be the father, he will be ordered to pay support. He can file himself for custody/visitation. The mother has 18 years from the date of birth of the child to file a child support case.

    I would also suggest to your bf that he not disregard the summons when it comes. He could be declared the father by default, if he doesn't show up for court.

    Thanks for the info.

    He can't be the father because he was not with her at the time she conceived the baby. He has not been handed court papers so that means that as of right now, he does not have a court date correct? We are just going by hearsay from what a friend of the ex had told him but apparently she has been talking about taking him to court since the baby was born but hasn't so I just think she knows deep down that it's really not his but can't think of who the real father would be.

    As soon as he is served with papers he needs to file an answer denying paternity and requesting a court ordered DNA test. The court will order the test, then a court date will be set.
