My fiance and I are co-lessees on an apartment in Valparaiso, IN. Without our knowing, we bounced two rent checks, as soon as we were informed of the NSF, by the bank, not the apartment complex, we took the money into the apartment manager. In our lease it states that if there are MORE THAN TWO NSF checks written in a 12 month period that checks will no longer be accepted. We wrote two and received a notice stating that they will not accept our recent rent check, that we may come pick it up and we must pay with a money order. When we told them what was in the lease they said they weren't going to re-write the lease and they have always stopped accepting checks once two are written, even though the lease states when MORE THAN TWO. They refuse to cash the check in their possession for rent and have threatened verbally with eviction. What can we do?
