We were served with papers to Terminate our Guardianship. My niece's (8) (her mother,my sister-deceased) Father is a convicted felon (Bank Robbery, Drug Possession, Parole violation, under the influence), still on parole. We have had her for 31 out of the last 35 months (24 months continous). He has not provided ANY support for this child. Legal Guardianship against his wishes granted 01/07.
She is thriving in school, at home and in sports. He's in new relationship ( 1 month)where woman (w/3 kids) "would marry him if she had to" to help him get his daughter. No problem with that.
My question is: Will he be as scrutinized as we were by a court investigator, i.e. home life, ability to provide for, discussion w/child. What are his chances??
We stopped his visits & phone calls in 07/07 when he became verbally abusive towards us. He was 2-4 hrs late if he showed at all. We had to call police when he blocked our driveway ranting and raving about seeing his daughter. She was frightened(seen & heard everything) and did not want to see him.
We want what is best for child. We wonder how much we should put ourselves & teen kids through. We don't want to keep him from her but are concerned with her well being and don't want him around our home. This is all very stressful.
ANY help would be appreciated!! Court date is Dec 3. What can we expect?
