    Default Fighting an MIP Ticket in Michigan

    Looks like I have the worst luck. I live in Michigan and attending college in michigan. I was on probation for another misdemeanor charge for being at the wrong place and wrong time. My probation ends in couple of months. Everything went well with it so far until I got a MIP ticket at my college campus last week. I was not drinking and did not posess any alcohol. Walking with 3 other girls on campus and a cop stopped us. I had a water bottle with crystal light. Two of them had admitted to drinking and they bew nubmers on their test and it was noted on their tickets. Me and another girl who was also not drinking told the cop we were not drinking. I asked the cop to give me Breathalizer and he refused. I told him my bottle contained water and Crystal Light. He did not check. He asked us to dump the bottles and wrote a ticket and when I asked him again to give me the breathalizer, he did not. He told me I can fight the ticket. I asked him if he is going to show up in the court and he said "probably not". I have 3 other people who can vouch for me that I did not had any alcohol. Since then I informed my Probationary officer and she said I have to appear in court for probation violation. She also heard my story and was sympathetic towards me. She said if they drop my MIP charges they will also dismiss probation violation. I am on YTA. I am doing very well academically and not a typical 18 year old who just screws up. My grades are good and I held jobs and did community service (not as part of probation) while in high school. Never even got a speeding ticket.
    What are my chances of fighting this ticket and having a clean record ? I have a court date in 2 weeks. Please help.

    Consider getting a lawyer to help you with the MIP. Depending on your college, you may be able to consult a lawyer for free through student legal services.

    I hired a lawyer (he is expensive and I got good references)and he finds out there was never a report filed so I got a second pretrial conf. no date yet. to make things worst my at my POV arraignment we learned that my PO's recommendations were so severe (revoke YTA, Jail time etc), I pleaded not guilty to the charge of probation violation, even my lawyer thinks it is just bizzare and we probably going to try this case. Hearing date is 2 months away. In the mean time we are trying to get MIP discharged. However, at my other district court getting a ticket itself is grounds for probation violation. I don't know how to prove my innocense. They say you are innocent until proven guilty.. but doesn't appear so in my case.. am I screwed for ever ???
