    Default Embezzlement Charges

    Help. I recently found out that I have an old warrant from 2004 for Embezzlement in Virginia, its now 2007 and I have never even been formally charged, is there a statute of limitations for this since I have never even been charged yet? Will it expire, what is the best route to clear this up?

    ALSO:

    my old boss from a 2005 job, (not the same as above) threatened embezzlement in the state of Maryland, to this day he has never even pressed charges, is there a statute of limitations in Maryland or should I not even worry about it since its been over 2 years and he doesn't even own the company any longer?

    If there is a warrant then you have been charged, and the statute of limitations is not running on that charge.

    You can read the Virginia criminal limitations statute here, Virginia Code § 19.2-8.

    even if I haven't even been questioned? I mean this was 4 years ago. How can someone be charged if never even questioned?

    also what is the statute of limitiations for a company to press charges for Embezzlement? I left the company in July 2005, he sold it in January 2006, and now I hear he wants to press charges even though all the money was paid back to him without ever going to court. Can he still file charges? This is for Maryland by the way.

    You don't need to be questioned before you are charged.

    Maryland has no statute of limitations for felony offenses.

    If he's waited two years to file charges, the police may be reluctant to pick up the case. However, you appear to have a history of similar offenses, and that may affect how the police treat the report.

    So even though he doesn't own the business he can try to press charges 2 1/2 years later even though all monies were paid back 2 years ago? See, I filed a complaint 2 months ago for him not reporting income. They placed a lien against him on 10/9. on 10/15 i get word that he is starting an investigation. Now is he just using a scare tactic at this point. That is what it sounds to me anyway. Now here is the twist, since I did the books for him, he was paying all his employee's between $3,000 to $5,000 every two weeks (for years) cash for overtime instead of reporting the income via taxes. Now if he is only trying to use a scare tactic, should I throw it back his way that I know this and that I will report him to the fed's for tax evasion if he wants to keep pursuing it?
