    Default Charged With Shoplifting Despite Store Policy

    Ok, so I was caught shoplifting in wal-mart, but heres the kicker, it was for a 12 dollar bottle of wine. Now, as this was my first time going through this I lied about having my I.D. in the office so they had to call a cop to come verify my identity. However, the associated said they would not and COULD not charge me for shoplifting since the amount was so low, but the cop however decided he would issue me two charges, one for the shoplifting, which he wrote as "under $200" which I thought to be interesting because it sure is under that and then some, and the other for underage posession. Now heres my question, is it even lawful for him to do that? he didn't make an arrest of any kind, and he was only called to verify my identity, does he actually have the right to do this? especially the underage posession charge, since i didn't even get off of wal-mart premises with this bottle? By the way I am in virginia, and I'll be 21 by the time I have to appear in court, so I think that may help me a little bit, I want to try to fight this in any way I can because I can't afford for something like this to go on my record. any help/insight at all would be appreciated, thankyou.

    The Officer had both the power and authority to take this action. By the way the time to worry about your record was before you stole not after.

    well thankyou smart alec, for telling me when I need to worry about my record. but I could use more help and less of your high horse smug replies. I 'm certainly not sorry for what I did and I could not care less. Wal-mart is among the most evil of corporations on this PLANET, I encourage stealing from them, though certainly people like you wouldn't, in your nice suits and expensive ties. Raping the planet and taking advantage of scores of impoverished people is all good and fine as long as you all make your money right?
