    Default Immigration for a Minor Son

    I have another question...My son ( 15 year ) is here with B1/2 visa and will be expired in December 2007. Should we file I-130 and I-485 through to my husband as his stepfather ( US Citizen ) or through me as his mom ( Permanent Resident ) while he is here? Or before the visa will be expired ..let him go back home first and we start to process the paper for him here?

    I would suggest having your husband petition for him as a minor step-child, as that would put him in the category of an immediate relative, not subject to numerical limitations under U.S. immigration law.
