    Default Is There A Chance I Will Be Able To Get Emancipated

    Hi, my name is Jaymie, I'm a 15 year old boy who lives in California. ive been living here for 3 months now with my mom and my Dad lives back in Washington state (where i used to live). i moved away from home (even though my dad has more custody over me than my mom does) and my mom said that she has to wait 3 more months to be able to file for full custody.

    The reason she wants to do that is because my situation at my dad's house was really bad and I want to be able to have nothing to do with him.

    My mom said she would allow me to get emancipated if I thought it was the best thing for me. I'm living with her now and its kind of hard for her because she doesn't have that much money and she only has a 2 bedroom house which is for her and my grandpa. so theres no where for me to really even sleep. i want to get emancipated and move back up to Washington. ive been living there my whole life and i dont want to move away from that, i had a good influence in friends up there, didnt get into that much trouble, and i dont feel like the kids down here aren't the best influence because my sister lived down here and she became a drug addict and a prostitute.

    i know that i could support myself because i can get a job up there, i have friends that will let me rent out a room at their house, and i have other friends who are 18 and looking for a roomate to rent out an appartment. we have been looking and there are 2 bedroom appartments for 875 a month. my mom is paying for my cellphone bill also. when i lived with my dad i was basically living on my own anyways. he didnt have a job and there was usually no food in the house. i had to find my own ways to make money to support myself, legal ways of course. i am going to school and plan to go to school till i graduate. i also have good grades and i get good grades.

    Do you think it is possible for me?

    Is there anything else that i should know or that would help me with this process?

    To emancipate you need to be self-sufficient when you go before the court. The court will not consider future plans to become self-sufficient. How can you support yourself, right now?

    Yes, there is. i forgot to point out that i am getting hired this week at Santa Cruz Guitars. i plan to keep this job until the time that i am able to be emancipated which should be anywhere from 3 to 4 months. Even if i dont want to work here anymore i will still stay so that i can prove i can hold down a job a keep a steady income.

    I hope this answers your question on being self-sufficient at this point in time. I feel that i am, but feel free to still let me know if this is what the judge would be looking for.

    Your "getting" hired? You know this for certain?

    Will your income be enough for self support?
    Do you have a place to stay (rent)
    Do you have a plan for independent living?
    Do you have a plan for continued edication?
    Do you have Health Care?
    Do you have transportation?

    Yes, i am getting hired. i do know this for certain for as i have talked to the manager and he said he would let me know when i start this week.

    1. My income will support me.
    2. My friends mom said she would rent out one of the rooms in her house for $200 a month.
    3. I plan to live with friends and/or roomates as there are plenty that want me to live with them.
    4. I plan to finish high school, yes.
    5. I do have health insurance, yes.
    6. I do have transportation. I will be getting my liscense around the time i get emancipated but if it comes down to it i can take the bus.

    So is this enough to get emancipated?

    You still have much to go and by the way only about 1% of all emancipation petitions are successful

    1. All bills gas, food, rent etc etc? Yes, food is not a problem, rent won't be either, and i won't have to pay any bills as electricity, water, etc. will be provided
    2. What happens if they mov eor change their minds? Well i wouldn't do this if i didn't have more than one option. I have 2 friends that will let me rent out a room at there house, and i have 2 other friends that want to rent out an appartment with me. so i definately have more than one option.
    3. What if roomates leave? I explained above. i have quite a few options.
    4. Really where? Is it yours or your parents? Right now it's my parents but i can easily afford it by paying for lowest insurance. My mom says its really cheap.

    You have a rather rose colred view of things how much money will you make each mont. By the way not paying utiltites works against you as a judge will look at how you will survive if things change as I mentioned. You need to be able to prove you can support yourself. On emore thing health insurance is not cheap!

    You seem to be operating under the assumption that as long as you can "prove" that you can support yourself, emancipation is a given. It is not.

    While you can't be emancipated UNLESS you can support yourself, there is more to it than that. As was said above, very, very few petitions for emancipation are granted. "I don't want to move" is not generally a good reason in a judge's eyes.
