    Default Emancipation Help

    Hi, my name is luke and my mother passed away last summer and i have to live with my step dad and i really don't like him. I also met my bio father over that summer. I want to get emancipated but don't know how i am 15 going to be 16 in about 3 1/2 months. I was reading the other ones on here and figured out that alls you have to do is just be able to support your self, is this true? I want to move out and have my real dad adopt me so i can go live with him, but he thinks it is best for me to live with my step. but i hate my step. So if some one could answer my question?
    How do i get emancipated?
    If i do decide to get this can i take my biological dads last name and live with him (adopted basically)?
    How much i would have to make to support myself?
    The best way to do this?
    Can my step dad stop the emancipation? or anyone?

    To be emancipated in Michigan, absent a circumstance which automatically results in emancipation (such as marriage or active duty service in the armed forces), you would have to convince a court you are able to support yourself, and are capable of managing your financial and social affairs. Michigan's emancipation statutes are available online.

    If your step-father has custody of you, he can oppose your petition.

    Were you previously adopted by your stepfather?

    Im not sure if he has or not ill have to check
    so if he dose adopt me he can stop the emancipation?

    Are you working?
    What is your income?
    Do you have a place to stay (rent)
    Do you have a plan for independent living?
    Do you have a plan for your continued education?

    I plan to be working in about 3 months
    and when i do ill figure all of the income and stuff like that out
    i was planning on staying with one of my friends for a couple of days till i either move in with my real dad or go live with my aunt
    and i still plan to go to school

    It isn't as simple as you are trying to make it. You cannot be emancipated unless you can support yourself, but that doesn't mean that supporting yourself is all there is to it. A judge can deny the petition if he does not find emancipation to be in your best interest, EVEN IF you can support yourself.
