    Default Civil Rights Ignored While In Police Custody

    I may need some creative thinking here. I was accused of something I didn't do and I went willingly to the police station to "help" them discredit the accuser and wound up there for 16 hours and finding them accusing me as well as interrogating me, holding me and not allowing me to leave when I tried and then 3 times refusing me an attorney when I requested to talk to my lawyer before answering anymore questions. I even offered DNA, Lie Detector and a signed Statement as long as a lawyer didn't have a problem with it.

    Well I am in need of some acid medication, Zoloft, and High Blood Pressure meds that I didn't take when they cam to my house because I thought I would be gone just a couple hours. I should have known something was up when they would not let me drive my own vehicle.

    Long story short, I eventually confessed to something. Not what I was accused of , but they told me the only way I was going home that night is by giving a statement. ZGiven the fact that I was refused a lawyer and freedom to leave when I wanted and wasn't even close to hearing anything close to Miranda, I figured it was a no brainer and I could confess to murder if I wanted to and get it tossed out on the Civil Violation.


    PROBLEM: I cannot prove any of it ! ! ! ! And I was indicted on my Statement! I am offered a plea to an E felony but with that comes registering as a sex offender.(which I am not)

    The other option is to let my very incriminating and vivid statement go to the Grand Jury where I will no doubt be charged with at least 7 A and B Felonies! I will probably not be able to post bail then, it will ruin my life and I will lose everything I own paying for it. On top of that if, if I get all the bogus charges dropped and just ONE sticks with a jury, I am going to Prison! I am a Correction Officer ! ! ! !

    I know my rights and that is why I played their game. But I have no proof. I did tell both detectives in the room that I will sign the Statement under duress. My fiance was calling and they were very rude to her and she had a miscarriage prior to being 9 months pregnant at the time all this happened. Our baby was born without a thyroid gland and I sometimes wonder if this caused it. The gland develops late in the pregnancy and this is the time when the ungodly stress was placed on my fiance. Thisis why I made the statement, so I could just go home. Even when I tried to get up and leave they got up and stood in front of me and would not allow me to leave, but would not give me my Miranda rights.

    However, when they wrote up the Statement they placed miranda on top page and asked me to sign and put the TIME on it! Then I signed the statement with a later time on it and it looks as if I was given my miranda rights and then gave a statement!!!!!

    What can I do ??????? The COPS LIED and promised me it would get reduced to a MISD. and I would probably get it dropped if discovery came back with nothing, so I signed it knowing there would be no discovery evidence. But guess what? My statement IS the evidence and my attorney tells me it will be almost IMPOSSIBLE to get it tossed with 2 of them against my word. He says they always lie and know how to get confessions while they smile right at you!!!!


    What can I do now?????? I need help. Court in 2 days to tell the judge if I accept the plea charges. He is "the hangin judge" also.....I will do time, I already l;ost custody of my son from my first marriage, I will lose my STATE job, my retirement,pension, etc. But if I fight it and the statement stays, then I am gone!!!!!!!


    HELP, what can I do?

    I have a lawyer. He wants me to take the plea or I am going to prison for a long time. The problem is Jesus Christ will not allow me to stand up and lie to a judge and say I did something of a lessor crime when I didn't. BUT, I think by taking the plea and doing a month or whatever and then filing a civil suit.

    Can I eventually get a CRD and adjudication?

    Odd that JC doesn't mind you lying in your written confession.

    Bottom line its gonna be your word against two L.E.O. your signed waiver of rights and your own confession.

    There must be more to the evidence besides your statement. (??) There should be witness contact reports, complaint or report from the accuser, and possibly any follow-up interviews depending on what those reports contain. Your attorney could have deposed the accuser. If your case goes to trial, what will they have as evidence? Who would show up to testify? Your attorney should know these things and your attorney should have all discovery. Your accuser could also be called to the stand - what would that person be expected to say? Could you attack the facts based on the known evidence? What happened to the actual perpetrator? Any other suspects? If you are totally innocent, I think you should go to trial, get on the stand and tell your story. The evidence would either substantiate what you say, or simply be insufficient to PROVE what the prosecutor will charge. Maybe talk to another lawyer and get another opinion. Your attorney wants to take the easy way out for his sake. Problem may be paying for a trial.

    Plus by your own admission you made a statement that implicates you in 7-8 Class A and B felonys? But of course you ARE innocent.You need to have the best reprsentation you can get, and even then, your goose may be cooked. Never ever make a false statement to the police no matter how long you are there. 16 hours will seem like a short time if you now go to prison for 15-20----Years.

    Are you the same corrections officer that posted a couple of months ago? He was charged with having a relationship with a female inmate?
