The income of both parties is taken into account. In many cases the CP cannot work since they have to take care of minor children, disability, etc. If the CP is able to work, the court will impute an income. Each parent has the right to become the CP. The court awards custody based on the best interests of the child. Is it unfair? Not according to our society. Effective birth control measures have been available for many years.
I agree!!! My husband was lied too and was trapped from the beginning. None of his children were planned, well not to his knowledge. With one of them he didn't even know she was was expecting(he was in Iraq) he recieved a call from his mom he had a new son....She is now pregnant again with her bf...Thats how she makes a living....Having babies!!

Sounds like a good arguement for change of custody. You don't need to change the law you need to use the current laws so childrens best interest is applied. Regardless your husband has a legal and moral obligation to help support his children.
Yes thank you and we both agree. He actually went to talk to a lawyer the other day and she just laughed at him when he asked about getting full custody. She basically told him that the system works for the woman and she would have to be on drugs before the kids get taken away from her. Which we kinda figured.

Oh really!!??? Well, after he talked to her(the lawyer) she decided not to take his case...She didn;'t want to get involved. So, he has to find another one anyways. But won't he have to have some kinda proof other than verbal, or the kids saying they're there all the time?

ok thanks again...but I have another question in Ky do you have to go through a lawyer to have cs reduced? He goes through friends of the court not child support. He has tried and tried to get in touch with someone in the office and no one can help him...it's a joke!!!!
