    Default Change of Custody and Child Support

    Hi, I live in Ohio. A year ago, my son decided that he wanted to live with his father instead of me. We decided that we wouldn't go to court to have everything switched that we would just agree to something between the 2 of us. Now, the child support is being modified to reflect the fact that my son lives with his father. The court is saying that I still have legal custody of my son, and that I have to give up legal custody of my son in order for the child support to be changed. Instead of going through that headache and trouble, can I go to the mediator and agree to take less child support a month? I still have 2 other children that live with me. Or, do we have to go to court and have everything switched?

    Isn't the mediator at the court house?
    But yeah, you need to have this signed off by a judge

    Can the 2 of us agree on an amount before we go to the mediator and just have the mediator sign off on that? It just seems like a big headache to go through all of this court stuff if I can get him to agree on the amount that it is supposed to be without going to court to basically have all of the papers re-written.

    Nothing is legal until a Judge signs an order, so going to court is going to have to happen.

    The two of you can agree on anything you like, then the agreement will go to the Judge, once the Judge signs the agreed to modifications will be legal.
