    Question Emancipation at 17 in Florida

    I have an odd situation. My aunt became my guardian only in the state of New Jersey at the moment I live in Florida with no problems. In sepember 2007 i became 17 and joined the Navy now i am in the DEP program; however, my mother was the one to sign off for all my papers,regarding my enlistemnt. My aunt can never make up her mind one day im kicked out the next not, constantly screaming, and refused to even sign me off to go to college because i graduate this december. Now, she doesn't want me in her house as of december and i finish high school in jan and leave for bootcamp in febuary. I have a job and have been working since I was 14. If my mother, whom resides in New Jersey, sends me a notarized letter saying that she gives me parental consent to move out is that enough?

    Does your Mother have any legal authority over you? You mention your aunt being your guardian. Who holds legal authority over you? by the way if you join the Military you become emancipated unless your enlistment ends before your 18th Birthday if so you revert back to parental care. Yes consent from whom ever has legal authority over you is enough to liv eon your own. We ar enow back to my orignal question who holds legal authority over you?

    well thats the thing the paper says "on said date all intrested parties have agreed that Nancy ( my aunt) shall have legal physical custody and that parenting shalle be allowed" to my mom vistation as desired. For a while my aunt has fobiden me from seeing my mom and vise versa because they got in a fight I plan to go see my mom before i leave for bootcamp. That is why my aunt is kicking me out and other reasons. I dont have any type of record and i am a good student. Yet my mother has been able to do all types of papers with me because my aunt has refused to do anything, allow college... nothing she refuses and oders my mother to sign off everything regarding me. The thing is ,although that is what the paper ordered, according to both of them in court the paper was only made so that i could stay with my aunt for a bit. The agreement was not made as a fight over custody. So i dont really know.

    Also, my OTHER aunt also had a guardiansip done with her ANOTHER child, when the child went to the hospital, they asked for guardianship papers. In the end the state of florida took over child declaring that the court papers were not valid in the state of florida becuase they were done in the state of new jersey.

    To emancipate in Florida, your parents or legal guardian must initiate the process.

    BTW, I am a notary public. Having a document notarized means only that the people who signed the document have been proven to be who they say they are. It does not have anything to do with the legality or the enforceability of the document in question. So a notarized letter from your mother is not going to have any enforceable weight. In Florida, the only way you can be emancipated is if your mother files the petition; a letter (notarized or not) is not going to be sufficient.
