I have full physical/joint legal of 2 children from marriage that ended over 8years ago (kids ages are 12 & 15). Recently (last year or so) the younger wanted to live with ex and ex wanted it as well. Things started to become tense around the house once I wouldn't go along with this so I finally gave in and allowed for the change. Younger child was sent to ex in CA (I am now in WA) back in June with the agreement that new court order would get drawn up ASAP at Ex's expense. Ex started paying half of cs since we each have 1 child and this would continue until a new cs amount was decided by courts. Ex has now stopped paying altogether, no new stipulation has been drawn up and my calls to my child are no longer returned. What now? I have a couple of questions for anyone who can help:
-Can ex arbitrarily cut cs in half without a modified order? Attorney seems to think a judge would be ok with it since we each have 1 child now.
-If ex should still pay full amount until new modification is complete, should I submit the current order to ex's work to get ex garnished (wasn't being done this way previously because ex is a job hopper).
-What is ex gaining by not modifying current order? It's been over 4 months now since child went to live with ex and still no new modification. I believe the child is considered a legal resident of CA once in the state for 6 months but does that matter with cs and custody issues?
-Should I just request child get sent back home and end all of this or is that possible at this point? Child has started school and I know judges don't like to interfere with this, but I think ex has proven that parenting skills are not abundant and child's best interests are not being served.
