I've been receiving some calls from one of my creditors regarding an account I defaulted on. I saw a number I did not recognise in the "Missed Calls" list on my cell phone then an incoming call came from that number. I found out it was the creditor calling seeking payment. I said I am not in a position to pay at this time as my cash flow is way down and I am broke. He said fine but the balance would go higher. He said they would be in touch and I asked how often and he said my number is in their auto-dialer. I requested that they not contact me anymore by phone and he said fine but last night I saw the same number in the "Missed Calls" list on my cell phone.
I live in CA where the state FDCPA does cover original creditors. Would it be feasible for me to send a limited cease and desist letter saying to cease all further contacts by phone but say that they are welcome to contact me by mail no more frequently than say once per month?
