    Unhappy Drunk in Public Probation Violation

    I was drunk last year and a friend and I took some things out of a car. It was dropped to trespassing as long as I didn't do anything else for a year. I also got three years probation.

    I got a "drunk in public" and have to go to court. I don't have an attorney this time around. Should I plead guilty and pay the fine? Should I plead no contest? Will it effect my probation since it is a misdemeanor? If I go before the judge in San Luis Obispo can I say anything else if I plead guilty (like give the bailif a note to give to the judge telling the judge I'm going to AA and give copies of my AA cards?) What is the best thing to do? I'm only 20.

    Hi,
    I am also staying in San Luis Obispo and is in the same situation - I am however 24. As I am exchange student I have really did a LOT of research upon this topic - talked to police, attorneys, SLO people and school....

    First and foremost, it is my understanding that there is no big difference between guilty and no contest. You should probably talk with an attorney about you probation - use the free consultation they all have.

    I have heard that nearly half of SLO has tried a drunk in public and just talks to the judge and pay the fine. However if you wan't to be sure it doesn't go on you record try to fight it in the court. In SLO it is seen as a traffic ticket as police gives out "drunk in public"s to nearly everyone who smells of alcohol....

    A court will treat a "no contest" plea in the same manner as a guilty plea - you would be convicted and sentenced.

    Particularly given that you are on probation, you should consult a criminal defense lawyer.

    Use what free consulation they have? Where? At the school or the public defender?

    The suggestion appears to be to try to find a criminal defense lawyer who offers a free initial consultation.

    And, since public intoxication is a misdemeanor that carries the potential of jail time, you may be eligible for a public defender if you have insufficient means to pay for your own attorney.
