    Post Delayed Medical Billing in Georgia

    In Feb. 2001 I had to be transported to the hospital via ambulance. They received all of my insurance information and filed a claim with my insurance company, which was paid by my ins. in Mar. 2001. I never heard anything else about it...no bill, no statement, nothing. My insurance company did send an explanation of benefits which stated the charge had been paid in March 2001. I got a bill in the mail today (10-06-2007) from the ambulance company wanting me to pay a leftover amount that supposedly insurance didn't pay back in 2001. This charge was incurred 6 1/2 years ago. I wasn't even aware there was an additional charge...like I said...no bill, nothing from them until today. My insurance company has already cleared this from their system, so they can't give me any information on it. The DOS is 02-04-2001. The statement date on the letter I received is 09-27-2007. Can they bill me for 6 1/2 years ago? Also, am I responsible for this charge, since my insurance company exp. of benefits says the claim was paid? What are my options and rights? Any help would be greatly appreciated.

    I believe the applicable statute of limitations is 6 years so based upon that, the debt is uncollectable through the courts. As well, a claim of laches would also seem applicable which means that since they did not make a claim within a reasonable time, you now do not ahve access to the info to argue it or that you cannot follow the typical channels to see why your insurance did or did not pay. (I understand the EOB you have. Just considering this is something that is not on that EOB)

    Then, you have your EOB. If whatever you are being billed for is within the charges on the EOB, then the claim should be dropped as it was apparently already paid.

    So, relying on your info, I would say you cannot be made to pay the bill although I, personally, would prefer it being cleared rather than simply not collectable through the courts since that could haunt you still.

    Thanks jk for such a quick response. I assumed it was way too late for billing. Finances weren't really the issue...it just kind of hit me out of the blue. It was just the principle of the matter. Agreeing with your suggestion, I will probably pay it anyway so that I don't chance messing up a good credit report that I've worked hard to get and keep. Just seems strange that they delayed the billing just long enough for the insurance company to wipe the file, that's all. But anyway, thanks again. Have a great day!
