    Question Missed the First Interview, and Denied

    i am from philippines,came here in america legally and I am now married to an american citizen,We filed 1-30 and got my employment authorization as well as my SS#.after 10 months we received our appointment to appear for our interview,but unfortunately the night before our first interview day,me and husband had an argument and that results us, to missed our interview day,after a month i received a letter from INS resulting of my denial,and telling that i have one month to file for motion,which i did not do. Its been almost been 2 years now,me and my husband are still together,but because of financial difficulties i was not able to re-file my papers,my question is,do i need to re-file again,I-30 or request to re-open my case.A friend of mine told me that i have to re-file and start again from the beginning,i need a legal opinion and advice,please help.Thank you in advance.

    If your original petition was deemed abandoned by your missing the interview and/or the subsequent passage of time, which I would expect to be the case, you start over.

    thank you for your reply,last time, i did all the paper works with the help of immigration lawyer,which is really a big help,but this time,i really want to save some bucks, and decided to do it myself,as far as i know,the forms i need to submit are G-325(husband and wife) I-30 and I-864 together with all supporting papers,and one more thing,Do all forms needs to be notarized?.as far as supporting papers are concerned,are as follows:
    1. Marriage certificate
    2.birth certificate (husband and wife)
    3.all copies of dessolution of previous marriage's
    4.tax returns and W-2's
    5.letter head employment letter (pay stub?)
    is there anything else i missed?
    Please bear with me,and your legal opinion and advices are highly appreciated,thank you.

    Follow these instructions, and the instructions on the various forms you have to prepare. If you don't feel comfortable following the instructions and doing things yourself, you may want to look into hiring a paralegal service to assist you, which should be significantly cheaper than a lawyer.
