    Question Possession of Burglar’s Tools

    My friend Jason and I went into a Sears’s store. He seen a DVD that he wanted. He looked at it and then left to go to the bathroom. I went out to much car waiting on him to come out. But he got caught shoplifting the DVD. The police were called. While he was in there with the police, another policeman came out to my car and asked me if he could search my car. I said no. But he said if I didn’t let him, he would break out my window and search it anyway. He said he doesn’t need a warrant in this situation. So I let him search it. As he was searching he found a tag remover. He told me he was taking it. He later came back and asked for my driver’s id. I gave it to him and asked if I was being charged with something. He said not yet. My friend came out and was issued a citation to appear in court. The officer gave me a receipt for the remover and we left. He had written my information on the paper as well as the remover. This was in Tennessee. He also wrote on the paper that the offense was shoplifting.

    Can I be charged with anything?
    Since I wasn't in Sears when my friend was caught, I was in the parking lot?
    How long do I have to wait before I would know something?
    And what is the statute of limitations on this situation?

    I did some research and found out that it is a class b misdemeanor. Tn Antt Code: 39-14-701
