    Default Child Visitation in Florida if Father is Not On the Birth Certificate

    My girlfriend and i live in Miami, Florida. I am not on the BC but lived with and raised my child for almost 2 years and raised my child alone when my girlfriend was out on business for few months.
    If i am the biological father, is there anyway she can take my child out of state without my permission, though i am not on the BC? What rights do i have since we were never married and she left the BC fathers name blank?

    You have the right to establish paternity/support/custody. Until you are legally adjudicated the father you have no rights to the child. If Mom is planning to move out of state you should file for paternity and request an court order that the child remain in the county until this is resolved. You can file today.

    Thank you. I stop working several months ago to take care of child full time and lived with relatives. Can i file without a lawyer? I know its better to have one but I'm looking for a job now hence no cash. I'm afraid I mess up the petition and won't be able to do anything about it.

    You would want to look into free legal services...most counties have agencies that will offer free or very low cost attorneys. But it isn't hard to fill out the forms to establish paternity. Custody is another matter...it you are forced to rep yourself make sure you learn the rules of procedure for your state. This site and others like it have lots of wonderful information if your use the search feature.

    Thank you. My ex is a great mom. Things didn't work out between us, I just want equal time with our child. Will it hurt me that I don't work but aggressively looking? I want to wait till I get money saved but am afraid if it takes too long to file for joint custody, it will look bad on my part. I heard judges will not grant jc if the parent isn't working. I'll wait your reply. thank you again.

    I have never heard of that!! Think about it...That would mean that ALL SAHM's would never get custody of their children.....

    Bay is correct, you do not have to hire an attorney. All of the forms can be found at www.flcourts.org there's alot of other info on that site also.
    You can read the child custody and paternity laws in chapters 61 and 409
