    Default Suspicious People In A Gated Apartment Complex Parking Lot

    Excuse me if this seems odd or unusual, but I have a situation that occurred last night and I really need some insight.

    I am a single mother of a toddler. We live in a "gated" community although I use that term very loosely after what occurred last night.

    As I was walking to my apartment with my son in tow, he was asleep until I picked him up and it was around 9:30 pm, I noticed 2 men walking from a different part of the parking area. I get nervous, so I start walking faster and as I begin to walk faster, they do also and they begin running toward me. One of them stopped and started pointing something toward me so I just ran to an apartment where I knew a policeman lived although I was aware that he was probably not a home since he lives across from me and I somewhat know that he works nights. He didn't answer so I ran into my apartment, closed and locked the door and then called the police.

    The police were unable to find the two men, as they arrived about 10 to 15 minutes after I called and I no longer feel safe in my apartment.

    Now after saying all of that, do you think that would be sufficient enough to get my landlord to allow me to get out of my lease. I just signed a new 12 month lease back at the end of June, but I don't want to live there anymore due to what happened. I know that I will most certainly move no matter the cost, but do you think the landlord would be able to charge me the fees that are listed in my lease under early lease termination? I am thinking the answer is no, but I am praying for some sort of way around paying for it.

    You have a signed lease your bound by that lease unless your landlord breaches it! What you can do is talk with Landlord about letting you terminate lease. this wil likely result in your paying several months rent in exchange if he/she agrees to early term of lease. If Landlord fails to agree to early termination than your stuck however does your "gated" community have meetings? If so discuss this at meeting or arrange one with your neighbors yourself.

    You indicate that there were two men in an apartment complex parking lot at night, so you want to move? You don't even have any evidence that they weren't residents, or that they were there for anything but innocent reasons.

    There were two men running toward me with a gun, that is why I want to move. I don't care whether or not they were tenants of the complex, that does not give them the right to come after someone with a gun.

    Now on to my next question, I reported this incident to the police as well as to the apartment complex. I actually spoke to two people in the office about it, once on the phone and once when I went into the office. I informed them that the gate was broken and has been for weeks and they said that they would get it fixed as soon as possible.

    Should the apartment complex have notified the other tenants within the complex of what happened to me? I ask because 2 days later a woman was robbed at gun point by two men fitting the description of the men that were coming at me with a gun. She was not able to get away without being robbed however. The police still have not found the suspects.

    When I arrived home yesterday I saw a letter on my door from the community explaining what happened and warning people to be careful. Shouldn't they have done that when I told them what happened to me 2 days prior to this incident? That could have either deterred the criminals if they were tenants of the complex, or made the other woman think twice about going outside at that time of night.

    Also would the police department be able to tell me how many times they have been called out due to the same time of incident in the past couple of months?

    There is no denying you have safety issues but I doubt its sufficent for breach of contract on your lease. Read your lease! Is there anything in regards to safety?

    No, it just advises us to use precaution.

    I intend on breaking the lease and paying the fees now that I know that, but is there anything that can be done as far as the apartment complex being responsible for notifying people of activities, especially if the police are called out.

    The second incident might have been avoided had they notified everyone and who's to say that this didn't happen to someone else who got away like I did.

    Is there any way I might be able to find out if these two were just isolated incidents or if this has been going on for a while and this is the 1st letter?
