    Question Name Change and Correction of a Birth Certificate

    Hello all,
    When I was 17 years old entering the Marines, my mother told me my father was "not" my real dad. It didn't matter since he left when I was 4. I have his name (first/last). He went on to make other children giving his first born with his new wife his first and last name too. I was 8 when I heard this news. So I decided to make up my own name. I have always used that name since age 8 and have always been known by that name. I am now 34 and somehow through the years it has become my name (not court ordered) on all my legal documents (Driver's license, Social security, college records, debts, etc..). I have had a rough life in the past as most people do. I have been through a bankruptcy, child support, prison, you name it. I did not use another name to escape the latter although I never had an I.D. with my new name until after. I have met my real father since and now seek to have his name put on my birth record and to change my last name to his. I was born in California and am now a legal resident of New Mexico. The father on my birth certificate is not a legal US citizen. Can anyone please tell me how do I go about having this done? I would greatly appreciate the legal advice. Thank you.

    One more thing I forgot to ask. Jurisdiction? Here are the facts: I was born in California. I am a legal voting resident of New Mexico now. My birth certificate father is an illegal alien. My biological father whom I want to change my name to is from Arizona (Arizona only allows adoptions under 21 years of age). Where do I file to have this all done legally?

    If you want to change your father's name on your birth certificate, assuming the "wrong father" was named, you will most likely need to do so through a state that permits adult adoptions and get the consent of your biological father.

    To legally change your own name, you would follow the procedures of the state in which you file the name change action. (California name change information is here; New Mexico forms are here, but depending on your locaiton you should check to see if you can get forms specific to your district) If not California, you would need to follow California's procedures to effect any name change on your birth certificate (forms here).

    First of all, thank you Aaron for such a speedy response! Secondly, my real father wants to do whatever we have to, in order for he to legally adopt me back into my rightful family. I have read that Arizona only permits adult adoptions until the age 21. I am 34. Finally, my question is do we have to file for adoption in the state of his legal residence (Arizona) or can we file here in New Mexico where I live?

    As you reside in New Mexico, you should be able to proceed through New Mexico's courts and laws.
