    Default Capital Punishment

    The highest court in our land has been asked to review if lethal injection warrants cruel and unusual punishment. In my opinion all forms of capital punishment is cruel and unusual. Now I know some of you out there live by the old "eye for an eye" philosophy. But it just seems barbaric to me.

    The United states is the only western nation that still exercises capital punishment. We are also one of few in the world that still practice it regularly. There are several nations that still have it on the books, but most have not used it in over 10 years. Syria, Iran, Pakistan, China, and the USA is where capital punishment is most common.

    Some people argue that capital punishment reduces crime. This is simply not true. The united state has the highest execution rate per capita, but we also have the highest incarnation rate in the world.

    None of us want these rapist/murders walking the street committing crimes. Life without parole, or 25-life is plenty of punishment. This way they will have to sit there and think about what they did for a long time. Some may even beg for the death penalty. It happened in Italy...

    Also, no system is perfect. There have been innocent people executed. No innocent should ever have his life taken away for a crime he did not commit.

    I have never been firmly pro or con on the issue. I am not of course for laws tantamount to the Draconian Code, but....

    It is an appeal from the Supreme Court of Kentucky, below, in where they ruled such lethal injection does NOT violate the 8th Amendment's provision on cruel and unusal punishment.

    When the Merits briefs are posted online, I will try to remember to post them.

    It takes at least 4 of the 9 Justices to vote to hear a case, that is, grant certiorari. I don't have any #'s on this case. All but Justice Stevens I believe participate in the Certiorari pool, so he votes without any influence/hints from the other justices at the roundtable.

    Capital punishment is NOT a deterrent to crime, I agree.

    I agree with this sentiment.

    However, in the US, we have a First and a Ninth Amendment. I submit, that if the public sector can engage in capital punishment; then, so can the private sector, as a form of freedom of religion and association.

    The point of this, is that of a form of balance of (moral) powers, between the people (who are religious), and the state; can be achieved when there is no hypocrisy between the state, and the people; via the 1A and 9A.

    Thus, if the religious are being denied and disparaged, holy and moral forms of capital punishment; then, the state should also be denied and disparaged the authority to engage in capital forms of punishment.
