    Default Medical Debt for an Adult Child in Missouri

    Are we liable for debt accrued after our child's 18th birthday?
    My wife carries her insurance, she is eligible till age 22.
    My wife is not her legal guardian.
    My daughter had a lengthy hospital stay.
    The debt has been assigned to my wife.
    Is this legal?
    Do we have any options?

    Did you or your wife sign a contract with any health care provider(s) indicating that you would be responsible for any amounts not covered by insurance?

    We did not. nothing was presented to us. We weren't aware of this until the collection started. I spoke with the hospital, they agree it's not our debt. But they stated that it will still be placed on my wifes credit.

    They're admitting that they're reporting a debt, and seeking to collect a debt, that (in their own words) they know you and your wife do not owe? Dispute it with the credit reporting agency. Consult a lawyer in your state about the possibility of suing the creditor for violations of the FDCPA and state consumer protection laws.

    Errinjan,

    What does the medical insurance policy say about coverage for your daughter under your plan? Most policies state the member is responsible for all charges for dependants on the policy.

    If your daughter signed a consent form at the hospital she was probably presented with a form that includes liability for all charges not covered by the 3rd party payor.
