Last November, I took a $80 item from Target. When I got home and discussed it with my partner, decided to go back the very next day and return to the store and admit what I had done. I brought enough cash with me to cover the costs (and possibly any fines), but instead they wanted the merchandise. The next day, I returned with the merchandise and was told that I had been filmed by survellience, police had been dispatched and I left before the officer arrived. About two weeks later, I was sent a statement and paid $300 in fines/fees associated with the incident. About a month after that, I get a call from the Sheriff's Department asking general questions about the incident. About 6-7 months after that, I received a notice that I was being charged for Theft 3 (WA State). I've been arraigned and have already plead not guilty. Not because I don't think I should be cleared of this, but because I'm about done with obligations related to a pre-trial diversion agreement (from a D.V. charge that I now wish I would have taken it to trial. Another story!). I'm 39 and that was the first time I had ever been arrested. Now, however, with this theft charge...if I plead or am found guilty, I will also face charges relating to that other incident. If I can somehow be cleared of the theft charges, I'll still be okay with both incidents. Do I have any options since I turned myself in the next day, returned the merchandise (no longer in packaging) and paid their fines?
