    Default Can Charges Be Filed After Everything Has Been Resolved

    here's the situation:

    -ran a horse boarding stable
    -landlords decided to sell the farm
    -gave boarders 30 days notice
    -had a horse on property, supposed to be a "free lease" situation, although NO contracts were signed
    -tried contacting owner to tell them barn was closing and needed to come get horse
    -no response from owner.
    -assumed horse was "abandoned", therefore decided to sell for 400$ to cover costs of trailering and feed
    -couple weeks later, previous owner found out, contacted police, who contacted me, told me to get horse back to original owner, or else i would be charged with Horse Theft.
    -called new owners, was able to pay them back the 400$ and horse was picked up by original owner.
    -no charges were laid.

    Question is-Can Charges be filed after everything is Resolved?? Can she come back a couple of weeks later or months, and decide to charge myself? Also, what would I or could I be charged with? I did everything the police officer told me to do and co-operated 100%.

    She would have to incur "damages" as far as her filing a civil suit against you. She got her horse back. Although you say no lease (no signed agreements), did she suffer any loss? Did you? Have you been compensated vis a vis any oral agreements or understandings regarding board, trailering, feed? As far as criminal charges, for the same reason, there is no substance to a charge of horse theft, or fraud or conversion, given you acted without malice, lacked intent to commit any theft/fraud/conversion. The DA would have to support charges with evidence - there is none. Why would the horse owner go to police instead of directly to you regarding the horse being sold in the first place? I don't think the police should have acted as judge and jury. They should have questioned you, found out about your prior actions to find owner, and amounts owing and left it between the two of you to sort out.

    In regards to the police officer, I tried explaining my "side of the story", yet he didn't want to listen, just told me I had no right to "give away" or "sell someone else's horse", which is obviously true, but considering I tried contacting the owner to explain the situation and gave her two weeks to reply-had no response, therefore decided to act on the InnKeeper's Act, however did it my way, not taking the correct legal steps to do it.
    I just wanted to know that this "mistake" or whatever it's called, is technically over criminally speaking and an officer won't be showing up telling me I'm being charged.
    In regards to whether or not she wants to sue me...it would be pointless as she got her horse back, she wasn't able to get the blankets back that had come with the horse, so I therefore bought them from her, her horse is fine...if anything its myself that is out the money for feed, trailering and overall cost of the horse.
