    Default Moving Out of State

    I have sole physical custody and joint legal custody of my daughter. I currently live in the state of Massachusetts but work in the state of Connecticut. Her father resides in a city about 60 miles west of me in Massachusetts. My question is, do I have the right to move to Connecticut or is this something that I'm going to have to address the court with?

    You would to either get written permission from Dad, permission from the court or both. It depends what the custody papers say. How far would you be from Dad in CT.? If the distance isn't any different (South central or Southwestern Ma. to Northern CT) then the move away could very well be granted.

    If the dad puts up any kind of a fight, you will have a very hard time moving out of the state.

    Not necessarily.

    As was stated, if the distance is roughly the same, there is a compelling reason to allow the move and an alternate visitation schedule is presented, it may not be that hard at all.

    It's a Massachusetts law. Can't move out of state unless the father and/or the courts allow it. It needs to be in the childs best interest. There has got to be a damn good reason to take the child away from 1 of the parents.
    My ex wanted to pull that stunt. Didn't work.

    If the distance is the same the court MAY grant the move. 60 miles is 60 miles.
