Please help me out, I don't know what to do.


My boyfriend and I were pulled over for driving suspiciously around my neighborhood. The cop said it was because of the tail light but then he said it was because he pulled out of my neighborhood and drove back in (dumb, I know). He asked if we had smoked, I believe my boyfriend said yes. We stepped out of the vehicle and the cop searched the car finding two pipes, a grinder, and no weed. although, he found a small baggy in my purse (which had sooo little, probably a stem and like 2 leaves who knows), but we weren't arrested. We both got tickets for the same thing, Possession of drug Paraphernalia (TX), and we're going to court on Oct. 15th, but different times. We're also 18 and 19.
*Shakes head* First of all NEVER incriminate yourself! You have the 5th amendment for a reason! Second, never, ever, ever, ever consent to a police search! But anyway...
Please, as much advice as possible?
How do we both make sure we can keep this off our records?
You will probably get a deferred sentence (usually some probation and 20 hours community service) Once completed, you can have the record expunged (erased).
Is pleading no contest the best idea?
Yes, since you have already incriminated yourself...
Will the cop that pulled us over be there?
Possible
Will the pipes be there?
Possible
Will I end up going to jail?
Poss. of paraphernalia is only a class C misdemeanor. Worst case is a 500 dollar fine. I suspect your fine will be about 150 dollars.
Is lying necessary?
You have the right to a speedy trial by a jury of your peers if you plea not guilty. But since you and him already made incriminating statements I suggest you take a plea.
