    Default Giving Notice During a Leave Of Absence

    I am in TX. I am currently on a medical leave of absence and a new opportunity came my way unexpectedly. I can be released to go back to work in a week or two (in physical therapy now). Do I have to go back to work before I give my notice or can I give my notice while I am on medical leave? The new company wants me to start in about three weeks. Thanks for your help.

    I could be wrong but if you give notice they can terminate you before that notic eis over. This means you have no source of income until you start new job.

    Wait, it might be a game of chess. I'm not an atty., but I do have employment knowledge. If you have a good employer who repects their employees and obligations, it would be best to give the traditional two weeks notice to preserve your references. And if you don't, it might be illegal in your state to terminate you before your medical leave is up.

    There is nothing in the law that prohibits you giving your notice while you are on medical leave.

    There is nothing in the law that prohibits your employer from accepting your notice immediately.

    There is no state where accepting an employee's notice immediately will be illegal, medical leave or no medical leave. There is also no state where being on medical leave is a guarantee of employment no matter what.

    Thanks so much for your help. Does anyone know if it would show up that I was on a LOA when I quit when a prospective employer calls to verify my employment? I really appreciate everyone's help!

    There is nothing in the law that would prohibit an employer from mentioning that you were on an LOA when you quit. Although I can't imagine why it would matter.

    I think you are trying to make this into a bigger deal than it actually is.
