    Default Shoplifted at a Military Store - Do I Have A Record

    I was caught shoplifting an ~$30 item at store within a military base in Fairfield, CA just short of 4 years ago (I was 20 at the time). I was detained and the base police came and took my information. I was not arrested but filled out some paperwork and admitted to the offense. I was banned from returning to that store for a year and I received a fine of $200 from the court in the mail a couple of weeks later. I ran a criminal background check through Intelius and nothing showed up. Is this a reliable source? Do I actually have a criminal record and is this something I have to report on my job applications?

    The $200.00 fine was not from court it was Civil Demand. Its a "civil" action not a criminal one. That is why you have no record.

    So was never actually convicted and would not need to report this on my job applications?

    There was no Police no court appearence and no criminal record. If a question is ask about criminal "convictions" the answer would be no! If asked about arrests the answer would be yes.

    Within the context of what is meant by "arrested" on a job application, I don't think that you were. After all, if you are stopped for a traffic infraction, you are technically arrested (temporarily). I think the term "arrested" on a job application is really intended to ask if you have ever been charged with a crime....and I don't believe you were. (Just my opinion)

    Since "Base Police" took OP's information I woud suggest that there could be an arrest record and that it "might" meet criteria for an arrest record. which is why I stated what I did. However as Chucky suggest there may not even be an arrest record.
