I'm having the same kind of issue, except--they can't or haven't served me. I was getting all sorts of ad letters from lawyers for bankruptcy and I didn't understand why, so I pulled my credit report. There was nothing on it from anyone named by this debt collector. So I ignored it, even though they were saying that they were filing legal action. This was in June 2007.
So I get a letter in the mail last week from the lawyer handling it. It's a letter of compulsion for discovery or something like that. It still doesn't say what this debt is. So I call the county clerk and they tell me that they can't tell me anything or see anything on the computer, but that I can come down and get a copy of it. She was shocked that i had not been served. She said that me getting a copy of it does NOT mean that I have been served.
So I went down there and I got it. They didn't make me sign anything and she didn't stamp it with anything. At least not the copy that I got.
Anyways, I have NOT been served, but some lady was coming by my house and knocking on my door a few times. I do not and I repeat, do NOT answer the door for anyone I don't know, any time, anywhere. Half the time my mom can't even get me to open the door. So I know I'm not going to be served. The clerk told me that if they can't serve me, then it can't go forward.
My question is how long do they try to serve and then what happens if they can't serve?
Okay, then, I'm trying to find out when the last date of the payment was on this account before it went into default. It's not on my credit report. So what does that mean?
How do I find out information about it if it's not on my credit report (anymore???) I'm wondering if it's really that old that if fell off the credit report, but they are still trying to get it.
It's been three months I guess since they've been trying to serve me. I see June 22nd stamped all over this thing.
