    Default Dismissed CWOF and N-400

    Hi- I am planning to apply for citizenship and have a question regarding Good Moral Character. In 1995, I got a CWOF in MA for larceny of property over 250 and use of false credit card under 250. Both were dismissed at the request of probation. Are these considered convictions? Will my application be denied and is there a chance I would be deported? Thanks for your help.

    a CWOF or "continuance without a finding" is predicated upon your admission of sufficient facts to support a conviction. Thus, although not a conviction for purposes of Massachusetts law, the USCIS will treat it as a conviction for immigration purposes. The impact on you will depend upon the maximum sentences for the charge, and whether the USCIS classifies them as falling under the petty offense exception to crimes of moral turpitude.
