    Default Fighting theft charges

    hi -

    thanks for posting your available advise. i was recently caught stealing and it was enough for me to change my mind about doing it again. to be honest, i'm planning on pleading not guilty, eventhough i was. i have worked in the retail business for quite some time and to be convicted would ruin my career, besides, the humiliation i was put through and the night in jail was a serious wake up call. my question is have you ever found that security tape was not enough to hold up in court to convict someone if they plead not guilty and how often do the loss pervention ppl show up in court, esp the ones that caught the person stealing ? i know as a lp guy you're probly thinking to tell me if you do the crime you do the time but honesty i wont be visiting this path again, i've truely learned my lesson, i just need this break because if i get convicted my life is even more ruined than if i go to jail, at least in jail you get three paid for meals a day and free room and board. neither of which i want but if i get convicted i might as well say goodbye to getting a job in retail the only thing i know.

    oh and btw, i'm not a citizen born in canada, and i didn't even think about the risk i was taking, not a risk i'm willing to take again.

    My first question for sticky fingers is how much is the dollar amount and were you on the clock or just a customer and is this your first offence

    You spending the night in jail seem a little extreme for just simple shoplifting.

    I would not plea not guilty, you see its kind of a mind game you don't know how much they know about what you did. so if you plea not guilty it will just piss them off and prosecute you to the fullest amount of the law however if your facing jail time the court can appoint you a lawer so take it. Work up a plea bargin which will decrease some of you sentence or what you have to pay out and even some of the charge.

    now if you go to court and you don't see the LP that caught you then plea not guilty and charges should be dropped for failure to appear because it shouldn't happen but some times LP forget about a court case or just don't make it. some court LP don't have to be at the plea hearing if this is just a plea hearing tell them you want legal representation and get a continuence.

    LP don't have to have surveillance tape of you doing anything their testamony is good enough for a conviction. Plus you have to remember if the lp has worked in the area for a good time they know the judge and their integerty is very good in that court system.

    i was shopping in macy's department store and it was for a piece of jewlery that was marked down to 35 but the original price was 200 dollars on the ticket the police gave me it was 208. i am planning to attain a lawyer when i do, should i tell them i may want to plead not guilty but tell them everything i told you. i'm not in the business of lying, i just want this to go away, and like i said, the stress that i've been under has been enough punishment. i've also read about plea bargining, that is definately an option i'm looking into, oh yeah, this is my first time, and i have a clean record.

    the dollar amount comes from what the store owns the merchandise at not what it was on sale or clearance for (ex. if they didn't catch you then come inventory time they are missing 200 in that piece of merchandise not the 35 that it was for sell for.

    Another thing to look into is what is call an open docket or a pre trail diversion this will allow you to pay the civil demand back to the store through the court and pay court cost but nothing will go on your record or pay the fine for shoplifting.

    you've given more advice than most are willing to offer.

    i'll be sure to post the outcome after court to let ppl know how it went.
    i hope ppl that come here see that this is a common thing but not to live your life that way. the results can sometimes be disasterous !!
