    Default Possession of a Switchblade in a Vehicle, in California

    On december 27th, 2006, i was charged with a possession of switchblade in vehicle. I was at an albertsons at 5:00 AM to get some bait for a fishing trip i was about to go to. While waiting, my buddies took out their plastic airsoft gun and just ran around the parking lot and shot each other. When the store opened, we went into the store and bought our bait. On our way out, there were 6 cops to greet us and we were all cuffed and detained for questioning because there was a report that someone was going to rob the store. The cop asked if he can search my car and i said yes. Long story short, he found a switchblade on my driver side that wasnt mine! It was a friend that just came back from iraq and had forgetten it there for the day before. So i ended up with the misdemeanor for it. I later appeared in court a month later and the DA's office informed me that they have not filed and to call back every month to check on the status. So i've been calling for the past 9 months!! Within the past 9 months, they have said no charges have been filed right now its "under" investigation. First question, is there anything i can do about it? Second question, how long do they have until they have to drop the charges? I am a paramedic and i was just at the wrong place at the wrong time. I'm about to start nursing school so i dont want this to come back and bite me. I also have a prior misdemeanor with possession of fireworks 2 years ago. PLEASE HELP!!

    A misdemeanor has 1 year to be filed. A violation of PC 653k (possession of a switchblade or gravity knife) is a misdemeanor. Therefore, in 3 more months you should be home free if no case has been filed with the court.

    hey carl, whats the likely hood that they will file, its been 9 months. If they do file, what do they need to do? I just dont want a warrant out for my arrest.

    They could issue a summons, or they could seek a warrant. If I had to guess, I'd say it won't happen. There is no really good reason why it should take 9 months.

    Consulting a local attorney might help you find out some finality to the matter, but this might cost you between $500 and $1,500 ... whether that's worth it for you or not is up to you.

    Law against switchblades are ridiculous and many cops and prosecutors, alike, realize that and set their priorities accordingly.
