    Default Possession of Drug Paraphernalia, in Texas

    Me, my roommate and our friend were smoking and drinking in our on campus apartment (2nd floor). They left to go get something to eat, and when they opened the door a cop was standing outside. They were pretty high and freaked out, and decided to turn around and go back in. A few minutes later a cop knocked on our door, and we quickly threw everything in our closets. I opened the door and he asked us to sit down. He then called us out one by one and asked us what happened. He said the place smelled of marijuana, and he proceeded to search our rooms. He found some beer, some weed, my bong and my pipe. Since we had basically under a bowl's worth of weed, he said he would throw it away and act like it was never there. And since we "cooperated," he decided to split the charges up, instead of giving us all 3 or so.

    So... I got a possession of drug paraphernalia ticket. My roommate got a minor in possession of alcohol, and our friend got a minor in consumption. We're all 18 by the way.

    My question is... what kind of punishment am I looking at? The only other thing I've ever received is a speeding ticket. I'm going to plan on getting is expunged. How many community service hours? What else am I looking at? And is my charge any more worse than theirs? Will I get a higher fine/punishment? I'm also not planning on telling my parents. They won't be involved in any way, since I'm 18, will they?

    You are most likely looking at probation and fines, and a driver's license suspension. Particularly if this is your first drug charge, I suggest consulting a local criminal defense lawyer as there may be a way to avoid a criminal record. If it takes telling your parents in order to be able to get help from a lawyer, you should consider telling your parents. You're a grown-up, so the court won't tell them.
