North Carolina's emancipation statutes provide:

i have read what you just posted, but i was wondering... im 16years old, and have a 18year olds friend who owns his own house, my mom and i have been a each other more and more for the past two years, and at this point she is threatening me to send me to foster care, or worse to go live with my drunken father. can i go live with my friend on these grounds? and if so.... currently my father pays my mom child support would i be able to recive that money or would the emancipation process legally remove me from my father as well? (they are divorced) i would stay in school, and i have a part time job. any advice or insight would be much appreciated.

Hypothetically, yes you would be emancipated from BOTH of your parents. I say hypothetically, because you will not be emancipated.

so i cannot choose emancipation over foster care even though i have a job, and a place to live?

1. Do you have your parents' consent to move out of your home?
2. Are your parents agreeable to supporting emancipation?
3. Do you have a work history that allows you to fully support yourself?
4. Do you have documentation showing that you are currently supporting yourself?
5. Do you have a financial plan that will appease the court?

I warn you. If your friend is of the opposite sex, you are going to play heck getting a court to approve of you moving into a friend's house. Emancipation is not designed to get a teen out of the home. Emancipation is to protect the minors that are already supporting themselves, for whatever reason.
