    Default Refusing To Identify The Father When Getting Public Assistance

    This is crazy i know. My friend had a baby with my husbands nephew. They were best friends (obviously with benefits). This man is now married to someone else and is having another baby with his wife. His wife knows nothing about the situation becausee they were engaged when it all happened. My friend wants the daddy to be a part of her baby's life but he refuses a paternity test by her and she wont make him get one. She doesn't NEED child support. Here is my question..... she is receiving help from the state and a paternity test was given to another man who she thought was the father so therefore she is still receiving help. I am just wondering can she get in trouble for knowing who the real father is and not doing anything about it? This is in the state of Nebraska.

    If she's receiving pubic assistance, she needs child support.

    She was perfectly happy to give them the wrong name in order to qualify for benefits, so it is absurd to pretend that she has some sort of valid basis for refusing to give them the right name. Tell her that it's time for her to grow up.

    Honestly that is not what happened. She was with a man for a year and a half, had one fling and thought it was her boyfriends baby. He wanted no part of the child once he found out she was pregnant. I'm know the whole wanting child support came from being angry with him but when he wasn't the father and the other man was she thought he would not want to tell his wife so she is not making him take a paternity test. She is getting assistance becasue she went back to school and is not working. She gets everything else paid for by her grandparents so honestly she really doesn't have a NEED for the child support money. This baby is now literally part of our family since my husbands nephew is the father and I want the truth to come out. What I want to know is.... is there some issue I can bring up to her legally about her knowing who the father is and not turning it into the state since she is receiving help?

    The father can bring a paternity action. The mother can bring a paternity action. The parents can execute an acknowledgement of paternity.

    She should expect the state to find out, and she shouldn't be hiding that information from the state. It's not the business of the taxpayer to subsidize her unwillingness to identify the father.

    She honestly thinks that it is okay for everyone BUT the parents to support the child?

    She's not expecting her grandparents to pay. They just give her money all the time without her asking. Honestly she is spoiled by them. Like I said the father is remarried and having a child with his wife. She would like him to be a part of the child's life but doesn't want to hurt his current wife. She thinks it will mess up their marriage. In the end I dont really care I just think he should have to take responsibility for his son and I cannot get through to them so thats why i wanted to maybe bring something up legally. She thinks she is being respectful to him by not making him do this. These people are all pretty young 22 and 23. I have talked to my sister in law who legally would be this baby's grandmother but she says she cannot MAKE him do anything and until he does they are not sure he is the father. He makes good money but does have alot of bills so she wont make him do a test because she knows it will hurt he and his wife financially.

    Do you realize that lieing to these agencies is purgery? She can be prosecuted for this.

    Perjury is a false statement made under oath. I doubt that her statement about the father's identity was made under oath. Which is not to say that knowingly misidentifying the father might not constitute welfare fraud.

    During a time when we were on aid we were told that any false statements made would be considered as purgery. I have no idea if it meanst the legal definition of purgery but it is what we were told by the Welfare fraud investigator durign the time we were on aid
